1. What is the current status of this Settlement?

If you submitted a timely claim and are looking for information relating to payment, please note that payment of claims was delayed, due to appeals filed by certain objectors, after the Court approved the settlement in 2014. Those appeals have now been resolved and payments are scheduled to be mailed in July 2016.
Please note that all action deadlines have now passed.

2. When will I receive my check?

Payments will be mailed in July 2016 to those who qualified for an award from this Settlement. The award amounts were calculated based on the terms of the Settlement Agreement.

3. How long do I have to cash my Settlement check?

Settlement Class Members have 90 calendar days after their initial settlement check is issued to cash their payment.

4. What happens if I don't cash my settlement check?

Settlement checks that are not cashed within 90 days after mailing of the initial check will be void and a stop payment will be placed on the check. If you do not cash your check, you waive any right to any portion of the Settlement Funds and you will be bound by the Settlement Agreement.
Funds from any uncashed settlement checks will be distributed to cy pres recipients, in accordance with the terms of the Court-approved Settlement Agreement.

5. What is the timeframe to request a reissued check?
Your written reissue request must be received by October 10, 2016 in order for your check to be reissued. Reissue requests received after this date will not be honored for any reason.
Please send your written request to: Honeywell Round Thermostat Settlement, P.O. Box 3053, Faribault, MN 55021-2653. Be sure to include your name and address so your record can be verified. The Settlement Administrator will review your record, verify that the original check has not been cashed, place a stop payment on the original check, and then reissue the check to you.

6. When will my check be reissued?

The Settlement Administrator will review your record and verify that the original check has not been cashed. If it has not been cashed, the Settlement Administrator will put a stop payment on the original check and then reissue the check to you. Reissued checks will be mailed within 6-8 weeks after the Settlement Administrator receives your request. If the check has been cashed, a reissued check will not be mailed to you.

7. How can I get a damaged/misplaced/lost check replaced?

If you have misplaced your settlement check or your settlement check is damaged, you may have your check reissued. Your written reissue request must be received by October 10, 2016 in order for your check to be reissued. Reissue requests received after this date will not be honored for any reason.
Please send your written request to: Honeywell Round Thermostat Settlement, P.O. Box 3053, Faribault, MN 55021-2653. Be sure to include your name and address so your record can be verified. Please include the damaged check, if possible.
The Settlement Administrator will review your record, verify that the original check has not been cashed, place a stop payment on the original check, and then reissue the check to you.

8. My name changed, because I got married/divorced/etc. Can I still cash the check?

Yes. Please go to your financial institution first as they may cash the check if documentation regarding the status of your name is presented. If your bank will not cash the check, please void the check and return it to the Settlement Administrator, along with a letter of instruction and proof of your name change (e.g., a copy of your marriage certificate or divorce decree). Please send the voided check, written reissue request and supporting documentation to the Settlement Administrator at Honeywell Round Thermostat Settlement, P.O. Box 3053, Faribault, MN 55021-2653.
Written check reissue requests must be received by October 10, 2016. Reissue requests received after this date will not be honored for any reason.

9. I recently moved and believe the payment was mailed to my old address. Can you update my address and re-mail my check?

 If you have moved, you may have your check reissued. Written check reissue requests must be received by October 10, 2016. Reissue requests received after this date will not be honored for any reason. Please write to the Settlement Administrator at Honeywell Round Thermostat Settlement, P.O. Box 3053, Faribault, MN 55021-2653 and include your full name, former address and current address.
The Settlement Administrator will review your record, verify that the original check has not been cashed, place a stop payment on the original check, and then reissue the check to you.

10. The person listed on the check is deceased. What do I do?

 Please go to your financial institution as they may cash the check if documentation regarding the status of the account holder and your status as the beneficiary/executor is presented.
If your bank will not cash the check, please void the check and return it to the Settlement Administrator. Include a letter of instruction, a copy of the death certificate and proof of your status as beneficiary/executor. If you are listed as the surviving spouse on the Death Certificate, this is all the evidence the Settlement Administrator will need to reissue the check to you. If you are NOT listed as the surviving spouse on the death certificate, you must also submit copies of the court documents that list you as the estate executor or equivalent.

11. The claimant is now under guardianship/has given me power of attorney, what do I do?
Please go to your financial institution as they may cash the check if documentation regarding the status of the claimant and your status as guardian/power of attorney is presented. If your bank will not cash the check, please void the check and return it to the Settlement Administrator, along with a letter of instruction and proof of guardianship/power of attorney. Please send the voided check, written reissue request and supporting documentation to the Settlement Administrator at: Honeywell Round Thermostat Settlement, P.O. Box 3053, Faribault, MN 55021-2653.

12. I received a Notice in the mail and/or an email.  What is this about?
The Notice is to inform you about a settlement of a class action lawsuit (“Settlement”). It also explains the lawsuit, your potential legal rights under the proposed Settlement, what benefits may be available to you under the proposed Settlement, and how to get them.

13. What is this lawsuit about?

The lawsuits claim that Defendant Honeywell International Inc.’s (“Honeywell’s”) illegal conduct resulted in increased prices for individuals that bought Honeywell Round Thermostats, in violation (in the California lawsuit) of the Cartwright Act (Cal. Bus. & Prof. Code § 16700, et seq.), the Unfair Competition Law (Cal. Bus. & Prof. Code § 17200, et seq.) as well as California’s common law of monopolization and (in the Vermont lawsuit) the Vermont Consumer Fraud Act (9 V.S.A. § 2451, et seq.).  Honeywell denies that it did anything wrong, and the Court has not decided who is right.

14. What is the Class Period?

For California, the class period is June 30, 1986 through December 5, 2013.
For Vermont, the class period is June 30, 1986 through October 31, 2011.

15. Am I a part of the Class?

You are included in the Class Action if you meet the following criteria:

• You are a person or business that purchased one or more Honeywell Round Thermostats;
• You are a resident of California or Vermont;
• Your purchase was made in California between June 30, 1986 through December 5, 2013; or in Vermont between June 30, 1986 through October 31, 2011;
• Your purchase was not made directly from Honeywell;
• You did not re-sell the Honeywell Round Thermostats;
• If your purchase was made in California, your purchase was not of a home or building with a preinstalled Honeywell Round Thermostat; and
• If your purchase was made in Vermont, and you purchased a new home with a preinstalled Honeywell Round Thermostat directly from the builder, you still own the home.

16. Who is the Defendant?

The Defendant is Honeywell International Inc., the manufacturer and marketer of the Honeywell Round Thermostat.

17. Am I being sued?

No.

19. Why is there a Settlement?

The Court did not decide in favor of Plaintiffs or Honeywell. Instead, both sides agreed to settle the lawsuit. That way, they avoid the cost of a trial, and the people allegedly affected will get compensation. The Class Representatives and their attorneys think the Settlement is best for everyone who is a member of the Class.

20. What does the Settlement provide?

The Settlement is for $8.15 million in cash.  After deduction of attorneys’ fees, notice and claims administration costs, and litigation expenses, 91.8% is expected to be available for distribution to eligible California Class Member claimants and 8.2% is expected to be available for distribution to eligible Vermont Class Member claimants.  More details about the distribution of the Settlement Funds are in the Settlement Agreement in the Court Documents section of this website.

21. Do I need to supply documentation/proof of what I purchased?

No proof of purchase is required for claims of one or two Honeywell Round Thermostats.  Class Members who wish to claim more than two Honeywell Round Thermostats must submit valid Proof(s) of Purchase for each additional Honeywell Round Thermostat claimed.

22. Has the Settlement been finally approved by the Court?

Yes.

The Superior Court for the State of California, County of San Francisco, granted final approval of the Settlement May 30, 2014.

The Vermont Superior Court, Civil Division, Orange County granted final approval of the Settlement July 1, 2014.

23. How will the lawyers be paid?

You do not need to separately pay the Plaintiffs’ lawyers.  Any award of attorneys’ fees expenses and costs associated with the litigation, and costs for disseminating notice to Class Members comes out of the Settlement and is subject to Court approval. 

The attorneys’ motion for fees, costs, and expenses (including payments to the Plaintiff Class Representatives) will be available on this website after it is filed on April 25, 2014.  Any attorneys’ fees, expenses and costs awarded by the Court will be deducted from the Settlement prior to distribution to the Class. Please see the Notice for more information.

24. What if I don’t want to participate?
